Terms of Service

These Terms of Service govern your use of Jakeandjulia.com and any purchases made through our website.

By accessing our website, creating an account or placing an order, you agree to these Terms of Service. Please read them carefully before using our website.

2. Use of Our Website

You may use our website only for lawful purposes and in accordance with these Terms of Service.

You must not:

  • Use the website for fraudulent, unlawful or misleading purposes.
  • Attempt to gain unauthorised access to the website or its systems.
  • Introduce viruses, malicious code or other harmful technology.
  • Interfere with the operation, security or availability of the website.
  • Use automated tools to copy, extract or misuse website content.
  • Provide false or misleading information when placing an order.
  • Use the website in a way that infringes the rights of another person.

We may suspend or restrict access to the website where we reasonably believe that these terms have been breached.

3. Eligibility to Place an Order

By placing an order, you confirm that:

  • You are legally capable of entering into a binding contract.
  • You are authorised to use the payment method provided.
  • The information supplied during checkout is accurate and complete.
  • You are purchasing products for lawful personal use.

If you are under 18, you should use the website only with the involvement of a parent or legal guardian.

4. Product Information

We take reasonable care to ensure that product descriptions, photographs, dimensions, materials, colours and other information are accurate.

However, colours and product appearance may vary slightly depending on your screen, lighting conditions and device settings. Minor variations may also occur where products are made from natural materials or produced in separate batches.

Product images are provided for illustrative purposes. Unless specifically stated, decorative items or accessories shown in a product image are not included.

Measurements are approximate and may be subject to reasonable manufacturing tolerances.

5. Product Availability

All products are subject to availability.

Adding an item to your basket does not reserve it. A product is only allocated to your order after the order has been accepted.

If an item becomes unavailable after you place an order, we will contact you and issue a refund for the unavailable item using your original payment method.

We may limit the quantity of products that can be purchased in a single order or by one customer where reasonably necessary.

6. Prices and Taxes

Prices are displayed in pounds sterling (GBP).

Prices include applicable taxes where required by law. Any delivery charges or other applicable costs will be clearly shown before you complete your purchase.

We may change prices at any time, but price changes will not affect orders that we have already accepted.

If a product is listed at an incorrect price because of an obvious error, we may cancel the order before dispatch. If this happens, we will notify you and refund any amount already paid.

7. Placing an Order

When you place an order, you are making an offer to purchase the selected products subject to these Terms of Service.

After placing an order, you should receive an email confirming that we have received it. This acknowledgement does not necessarily mean that your order has been accepted.

A contract is formed when we send confirmation that your order has been accepted or when the products are dispatched, whichever occurs first.

Please check your order details carefully before submitting your order.

8. Our Right to Refuse or Cancel an Order

We may refuse or cancel an order where reasonably necessary, including where:

  • A product is unavailable.
  • Payment cannot be authorised.
  • We identify an obvious pricing or product information error.
  • We suspect fraud, misuse or unauthorised activity.
  • Delivery cannot be completed to the address provided.
  • The order breaches these Terms of Service.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled products.

9. Payment

Available payment methods are displayed during checkout.

You must provide current, accurate and complete billing and payment information.

Payment may be authorised or collected when the order is placed. Orders will not be processed unless payment has been successfully authorised.

Payments are processed through secure third-party payment providers. Jake and Julia does not normally store complete payment card details.

Further information is available in our Payment Policy.

10. Delivery

We currently deliver to eligible addresses within the United Kingdom, subject to the delivery areas stated in our Shipping Policy.

Estimated processing and delivery times are provided for guidance and are not guaranteed delivery dates unless expressly stated otherwise.

Delays may occur because of circumstances outside our reasonable control, including courier disruption, severe weather, public holidays, customs procedures or unusually high order volumes.

You are responsible for providing a complete and accurate delivery address. We are not responsible for delays or failed delivery caused by incorrect or incomplete information supplied by you.

Please review our Shipping Policy for full information about delivery areas, charges, processing times and tracking.

11. Risk and Ownership

Responsibility for the products passes to you when they are delivered to the delivery address provided in your order, or to a person authorised by you to receive them.

Ownership of the products passes to you once we have received payment in full and the products have been delivered.

12. Cancelling an Order Before Dispatch

To request cancellation of an order, contact us as soon as possible at info@jakeandjulia.com.

We will try to cancel the order before it is processed or dispatched, but we cannot guarantee that cancellation will be possible.

If the order has already been dispatched, you may need to follow the returns process after delivery.

13. Your Right to Cancel an Online Order

Where the statutory cancellation right applies, UK consumers generally have the right to cancel an online purchase without giving a reason within 14 days after receiving the goods.

Our separate Return & Refund Policy may provide a longer voluntary return period. Any additional return period does not reduce your statutory rights.

Some products may be excluded from the statutory cancellation right, such as personalised or made-to-order goods, sealed products that are unsuitable for return for health or hygiene reasons once unsealed, and other products excluded by applicable law.

Full return instructions, eligibility conditions and refund information are provided in our Return & Refund Policy.

14. Faulty, Damaged or Incorrect Products

Please inspect your order after delivery and contact us promptly if an item is faulty, damaged, not as described or different from what you ordered.

We may ask for photographs or other reasonable information to help us assess the issue.

Where required by applicable consumer law, we will provide an appropriate remedy, which may include repair, replacement, a price reduction or refund.

Nothing in these Terms of Service limits your statutory rights in relation to faulty or misdescribed goods.

15. Returns, Exchanges and Refunds

Returns, exchanges and refunds are handled in accordance with our Return & Refund Policy.

Unless the product is faulty, damaged or incorrect, you may be responsible for the cost of returning it.

Approved refunds will normally be issued to the original payment method. Processing times may vary depending on your bank or payment provider.

16. Promotions and Discount Codes

Promotions and discount codes may be subject to separate conditions, including validity dates, minimum purchase requirements and product exclusions.

Unless otherwise stated:

  • Only one discount code may be used per order.
  • Discount codes cannot be exchanged for cash.
  • Discounts cannot be applied retrospectively.
  • Promotions are available while stocks last.

We may withdraw or amend a promotion where reasonably necessary, but this will not affect orders already accepted.

17. Customer Accounts

You may be able to create a customer account to view orders or manage certain information.

You are responsible for keeping your login details confidential and for activity carried out through your account.

Please notify us promptly if you believe that your account has been accessed without authorisation.

We may suspend or close an account where we reasonably believe it has been misused or compromised.

18. Reviews and User-Submitted Content

If you submit a review, photograph, comment or other content, you confirm that:

  • The content is accurate and based on your genuine experience.
  • You have the right to submit it.
  • It does not infringe another person's rights.
  • It is not unlawful, abusive, misleading or defamatory.
  • It does not contain malicious code or unsolicited advertising.

You grant us a non-exclusive, royalty-free permission to display and use the submitted content for operating and promoting our business, subject to applicable law.

We may remove content that breaches these terms or is otherwise inappropriate.

19. Intellectual Property

The website and its content, including text, graphics, branding, photographs, product descriptions, layout and design, are owned by or licensed to Jake and Julia and are protected by applicable intellectual property laws.

You may use the website for personal, non-commercial shopping purposes. You must not copy, reproduce, distribute, modify, publish or commercially use website content without prior written permission.

20. Third-Party Services and Links

Our website may contain links to third-party websites or use services supplied by external providers, including payment, delivery, analytics and social media services.

We are not responsible for the content, availability, security or practices of third-party websites. Your use of those services may be governed by separate terms and privacy policies.

21. Website Availability

We aim to keep the website available and accurate, but we do not guarantee uninterrupted or error-free access.

We may temporarily suspend or change parts of the website for maintenance, security, technical or operational reasons.

We will not be responsible for website unavailability caused by events outside our reasonable control.

22. Our Responsibility to You

We are responsible for losses that are a foreseeable result of our breach of these Terms of Service or our failure to use reasonable care and skill.

We are not responsible for losses that were not foreseeable when the contract was formed or for losses caused by circumstances outside our reasonable control.

We supply products for private and domestic use. Unless otherwise agreed, we are not responsible for business losses, including loss of profit, revenue, business opportunity or commercial interruption.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for:

  • Death or personal injury caused by negligence.
  • Fraud or fraudulent misrepresentation.
  • Breach of statutory consumer rights.
  • Any other liability that cannot legally be excluded or limited.

23. Events Outside Our Control

We will not be responsible for delay or failure caused by events outside our reasonable control.

Such events may include natural disasters, severe weather, transport disruption, industrial action, government restrictions, telecommunications failure, cyber incidents, supplier disruption or courier delays.

We will take reasonable steps to reduce the effect of the event and keep you informed where your order is materially affected.

24. Privacy and Cookies

We process personal information in accordance with our Privacy Policy.

Our use of cookies and similar technologies is also explained in that policy and through the cookie preferences available on our website.

25. Changes to These Terms

We may update these Terms of Service to reflect changes to our business, website, services or legal obligations.

The terms that apply to an order are those in effect when the order is placed. Changes will not normally affect contracts already formed.

The latest version will be published on this page.

26. Severability

If any part of these Terms of Service is found to be unlawful, invalid or unenforceable, the remaining provisions will continue in effect.

27. No Waiver

If we do not immediately enforce a provision of these terms, this does not mean that we have waived our right to enforce it later.

28. Transfer of Rights

We may transfer our rights and obligations under a contract to another organisation where this does not reduce your rights.

You may transfer your rights or obligations only with our written agreement, except where applicable law gives you the right to do so.

29. Third-Party Rights

These Terms of Service are between you and Jake and Julia. Unless applicable law provides otherwise, no other person has the right to enforce them.

30. Governing Law and Disputes

These Terms of Service and contracts formed through our website are governed by the laws of England and Wales.

If you live in Scotland or Northern Ireland, you may also be entitled to rely on the mandatory consumer protections and courts available in the part of the United Kingdom where you live.

We encourage you to contact us first so that we can try to resolve any concern or dispute directly.
